Summary
Opporty International, a purported blockchain marketplace for small businesses, ran an ICO of "OPP Tokens" from September 2017 to October 2018, raising approximately $600,000 from nearly 200 investors. [1][2]
The fraud
Per the SEC, founder Sergii "Sergey" Grybniak and Opporty made material misrepresentations — falsely claiming the ICO was "SEC registered" and "100% SEC compliant," exaggerating the platform's user numbers and growth, misrepresenting a purported partnership with a major software company, and misappropriating third-party content to fake user activity. [1][2]
Outcome
The SEC charged Grybniak and Opporty (antifraud and registration) in January 2020. After a 2024 partial summary judgment, a February 2025 final judgment imposed permanent injunctions, a $100,000 civil penalty on Grybniak, a conduct-based injunction, and token-disabling undertakings. [1][2]
